STANDARD TERMS AND CONDITIONS OF BUSINESS EFFECTIVE
1 JANUARY 2001.
1. LIABILITY
The engagement of a AMSCO BV candidate will be deemed acceptance
by your company of all terms and conditions of business stated in this
document. A Fee is due from your Company once an applicant, introduced
by AMSCO BV, commences employment or becomes an agent or business partner
, in any capacity trial, contract or permanent basis with YOUR COMPANY,
IT’S COMPANIES or ANY COMPANY TO WHOM YOUR COMPANY IN TURN INTRODUCED THE
APPLICANT. Any subsequent introduction or effort by another consultancy,
agency, party, the candidate or your company itself does not in any way
limit our rights in respect of the fee.
2. MODE OF INTRODUCTION
An introduction can take place either telephonically or in writing,
namely, the receipt of the Curriculum Vitae or similar document. No service
warranties are made as all recruitment services are free and your company
is only charged upon the commencement of the applicant.
3. FEE STRUCTURE AND CALCULATION THEREOF
The fee structure is based on the Gross salary offered to the candidate.
This includes the basic salary and if applicable 13th cheque. AMSCO BV
recruitment fees are 18 % of the yearly gross salary.
4. PAYMENT
As invoicing is only done on commencement of employment and not on
acceptance of the candidate, the fee is immediately due and payable. All
overdue accounts which remain unpaid shall attract penalty interest at
the rate of 1% per month from date of invoice. If the fee is subject to
VAT , the VAT will be shown separately on the invoice, in addition to the
18 % fee.
5. WARRANTY
AMSCO BV will attempt to provide accurate details of candidates in
terms of their qualifications, personal details and their experience. This
is, however, primarily based on the information given by the candidate
themselves. No responsibility therefore can be accepted by AMSCO BV for
errors, omissions or mis-representations. The company agrees that the onus
is on them when interviewing candidates, to satisfy themselves as to the
candidates capabilities, state of health, integrity and suitability for
the company and that it is your company that makes the final decision as
to the suitability of the candidate. AMSCO BV and/or its employees accept
no responsibility or liabilty for any loss, cost of damages caused (directly
or indirectly or otherwise) by the candidate or the employment of the candidate.
6. CONFIDENITALITY CLAUSE
Due to the confidential nature of the candidate’s particulars, under
no circumstances is your company to contact either the candidate directly
or indirectly, or the candidates present employers without the consent
of AMSCO BV.
7. GUARANTEE OPTION
On commencement of the employment with your Company of the applicant,
whether on a permanent or other basis, your company will be invoiced and
the fee is immediately DUE & PAYABLE. In order to derive ANY benefit
from the GUARANTEE SYSTEM, the fee must be received within 30 DAYS of the
commencement date, accounts not settled in full within this period, will
result in the GUARANTEE being waived by your company.
Should the candidate be discharged from your employment within 90 days
from commencement, due to INCOMPETENCE, and providing we are NOTIFIED within
14 days of such dismissal, AMSCO BV , undertakes to refer further candidates
for your consideration as free replacements. The service is free providing
the position/remuneration are consistent.
Should your company, for any reason, decide not to replace through
AMSCO BV
a non-refundable credit note of 50 % of the value of that placement
will be issued in favour of your company.
8. DISPUTE CLAUSE
When the remuneration is un-realistically low or is disputed, the package
value will be calculated at the most recent realistic income that was earned
by the candidate at a premium of 120%.
9. ACKNOWLEDGEMENT
The company or its representative hereby acknowledges that he/she has
read, agrees with and has authority to bind the company to these terms
and conditions of this contract upon interview of the candidate and further
agrees that the engagement of a AMSCO BV candidate will be deemed acceptance
of all the standard terms and conditions set out herein. |
